01Bookings & Eligibility

• The guest making the reservation must be at least 18 (some properties require 21 or 25) and is the responsible party for the entire stay.
• A reservation is confirmed only when you receive written confirmation from LuxStay and the required deposit or payment has been received.
• The maximum occupancy stated for each property may not be exceeded without prior written approval.
• A signed rental agreement may be required and forms part of these Terms.

02Rates, Fees & Payment

• Rates are quoted per property and may vary by season, length of stay, and demand. Applicable taxes and fees are disclosed before payment.
• A deposit is due at booking; the remaining balance is due before arrival per your confirmation.
• Additional services (e.g., pool heating, event hosting, private chef, transportation) may carry separate fees disclosed in advance.
• Booking directly with LuxStay carries no third-party platform service fees — our Direct Booking Guarantee.

03Cancellations & Refunds

Cancellation terms vary by property and rate and are stated on your confirmation or rental agreement. Unless otherwise specified, deposits may be non-refundable. We strongly recommend travel insurance. Refunds, where applicable, are processed to the original payment method.

04Check-In, Check-Out & Access

• Standard check-in and check-out times are stated per property; early/late requests are subject to availability and may incur a fee.
• Certain properties (e.g., Corolla 4×4 beach estates) require a suitable 4WD/AWD vehicle or use of designated parking and shuttle services.
• Guests are responsible for securing the property and following access and key/lock instructions provided.

05House Rules & Guest Conduct

• No smoking indoors. No unauthorized parties or events. Quiet hours and community rules must be observed.
• Pets are permitted only where stated and with any applicable pet fee and approval.
• Guests must treat the property and neighbors with respect and comply with all applicable laws and HOA/community regulations.
• Violations may result in additional charges or removal from the property without refund.

06Security Deposit & Damages

A refundable security deposit or damage protection may be required. You are responsible for loss or damage to the property and its contents during your stay beyond normal wear and tear, and for any charges arising from rule violations (e.g., smoking, unapproved events, excess guests).

07Events

Events are permitted only at designated properties with prior written approval, a signed event agreement, an event fee, and any required event liability insurance. Guest counts, vendors, and timelines must be approved in advance.

08Assumption of Risk & Liability

Use of pools, hot tubs, beaches, water access, and recreational amenities is at your own risk. To the fullest extent permitted by law, LuxStay is not liable for personal injury, illness, loss, or damage to persons or property except where caused by our gross negligence or willful misconduct. Our total liability for any claim is limited to the amounts paid for the affected stay.

09Indemnification

You agree to indemnify and hold harmless LuxStay, its owners, and partners from claims, damages, and expenses arising out of your stay, your guests’ conduct, or your breach of these Terms.

10Force Majeure

LuxStay is not responsible for failure to perform due to events beyond our reasonable control, including weather, natural disasters, utility failures, government actions, or other emergencies. In such cases we will work with you in good faith on rescheduling or available remedies.

11Website & Intellectual Property

All content on our website — text, images, logos, and design — is owned by or licensed to LuxStay and may not be copied or used without permission. Availability, pricing, and descriptions are subject to change and may contain occasional errors.

12Governing Law & Changes

These Terms are governed by the laws of the state in which the booked property is located, without regard to conflict-of-law rules. We may update these Terms from time to time; the version in effect at the time of your booking applies to that reservation.
